Employer Terms and Conditions of the Jober.uk Platform
1. General provisions
The website Jober.uk (the "Platform") is owned and operated by Jober Ltd, having its registered office at 406 Teyleur, Manchester, M50 3AQ, United Kingdom, and registered under company number 15328589 (the "Owner").
These Terms and Conditions (the "Terms") govern the use of the Platform by employers, recruiters and employment agencies (together, the "Employers").
The Terms apply in particular to the creation and use of employer accounts, the publication of job advertisements and the management of recruitment processes via the Platform.
By creating an account or using any functionality of the Platform, the Employer confirms full and unconditional acceptance of these Terms.
The Platform must be used in accordance with applicable laws of England and Wales, UK GDPR, and any other applicable international or European legislation retained in UK law.
Employers must not publish content that:
is unlawful or infringes the rights of third parties;
violates copyright or other intellectual property rights without authorisation;
is offensive, defamatory, obscene, pornographic or otherwise inappropriate.
The Owner shall not be liable for any loss or damage resulting from temporary unavailability of the Platform, system errors or technical failures beyond the Owner's reasonable control.
2. Employer account
Registration as an Employer requires the provision of a valid email address, which shall serve as the username.
Employer accounts are activated only after successful email verification.
The Employer is responsible for maintaining the confidentiality of account credentials and for all activities carried out using the account.
The Employer warrants that all information provided regarding its business or organisation is accurate, complete and up to date.
The Owner reserves the right to suspend or terminate an Employer account without prior notice if the Employer:
breaches these Terms;
posts misleading, false or fraudulent job advertisements;
uses the Platform to advertise competing services or otherwise harms the Platform;
misuses candidate data or breaches applicable data protection laws.
3. Job advertisements
The content of job advertisements published on the Platform is the sole responsibility of the Employer.
Each job advertisement must relate to a single, clearly defined position.
Employers may publish multiple job advertisements, provided that each advert relates to a separate role.
The Owner may remove job advertisements and block accounts where:
the Terms are breached;
the advertisement damages the reputation or proper operation of the Platform;
duplicate or substantially similar advertisements are published.
4. Job offer content rules
The content of a job advertisement published on the Platform must relate exclusively to the advertised role and the recruitment process conducted via Jober.uk or the functionalities made available by the Platform.
Job advertisements must not contain:
email addresses used for applying outside of Jober.uk;
links redirecting candidates to external recruitment forms, websites or other job portals;
promotion of other portals, recruitment services, websites or services unrelated to the advertised role;
instructions directing candidates to apply outside of Jober.uk, bypassing the functionalities made available by the Platform.
Job advertisements may include the role description, requirements, benefits and company information. Applications are handled via Jober.uk or, where available under an active subscription, an approved ATS integration.
Redirecting candidates to an external Applicant Tracking System (ATS) or enabling applications by email is permitted only via the dedicated functionalities offered by the Platform and may require an active subscription. Such redirection must not be implemented through free-text fields of the advertisement.
Where these rules are breached, the Owner is entitled to:
edit or hide the prohibited elements of the advertisement;
block the publication of the advertisement;
remove the job advertisement;
block the user account.
Actions referred to in clause 5 may be taken without prior notice to the Employer.
5. Candidate data and Employer responsibility
When candidates apply for job advertisements via the Platform, their personal data, including CVs and contact details, are transmitted to the Employer.
Upon receipt of candidate personal data, the Employer acts as an independent data controller for the purposes of the UK GDPR and the Data Protection Act 2018.
The Employer is solely responsible for:
processing personal data lawfully, fairly and transparently;
using candidate data exclusively for recruitment purposes relating to the advertised position;
implementing appropriate technical and organisational security measures;
responding to data subject requests in accordance with the law;
complying with lawful data retention requirements;
notifying the relevant supervisory authority of any data breaches where required.
Employers must not:
sell, disclose or transfer candidate data to third parties without a lawful basis;
use candidate data for purposes unrelated to recruitment;
contact candidates for marketing purposes without explicit consent;
retain candidate data for longer than necessary.
The Employer agrees to indemnify and hold harmless the Owner against all claims, losses or liabilities arising from the Employer's breach of data protection obligations.
6. Electronic communications
By using the Platform, Employers consent to receiving necessary service-related communications, including:
account verification and security alerts;
notifications of candidate applications;
important service notices and updates to these Terms;
payment and subscription confirmations.
Marketing communications shall be sent only with the Employer's explicit consent and may be withdrawn at any time.
Employers must comply with applicable anti-spam and data protection laws when communicating with candidates.
7. Fees and subscriptions
Basic job advertisements on the Platform are offered free of charge.
Premium features, job promotion options and additional services may be subject to fees as specified on the Platform.
The Owner reserves the right to amend pricing at any time. Existing subscriptions shall continue on the agreed pricing until renewal.
8. Referral programme
Employers may enable referral programmes for their job advertisements through the Platform.
The amount and conditions of referral rewards are determined solely by the Employer.
Employers are fully responsible for paying referral rewards to eligible referrers.
The Platform facilitates tracking only and does not guarantee or assume liability for referral payments.
The Owner reserves the right to disable referral functionality for Employers who fail to meet their payment obligations or engage in fraudulent activity.
9. Disputes
The Owner is not a party to disputes between Employers and candidates or between Employers and referrers.
Information shall be disclosed only where required by law or a competent authority.
10. Intellectual property and security
All Platform content, including logos, designs, layouts and templates, is protected by intellectual property laws.
Unauthorised attempts to access databases, source code or servers of the Platform may result in civil and criminal proceedings.
11. Changes to the Terms
The Owner reserves the right to amend these Terms at any time.
Continued use of the Platform following any changes constitutes acceptance of the amended Terms.
